1. Parties
These Terms & Conditions ("Agreement") are between Fifty ("we", "us", "our") and you, the customer ("you", "your"). By proceeding to checkout you confirm you have read, understood, and agree to be bound by this Agreement.
2. Services
We will design, build, and host a custom website for your business. The website will be delivered within the timescales outlined in our onboarding confirmation. Ongoing hosting, SSL, and unlimited minor updates are included in the monthly subscription.
3. Subscription & Billing
The monthly subscription fee is £50.00 per month, billed on a recurring basis from the date of your first payment. Your first payment also includes a one-time setup fee of £50.00. If you add the Professional Logo Design add-on, the additional £19.99 one-time fee is charged on your first payment.
Payments are processed securely via Shopify Payments. By subscribing you authorise us to charge your payment method on a recurring monthly basis until you cancel.
4. Cancellation
You may cancel your subscription at any time by giving us 30 days' written notice by email. Notice must be sent to our support email address. You will continue to have access to your website until the end of the notice period. No refunds are issued for any part of a monthly subscription period already paid.
Upon cancellation, we will provide you with a full export of your website files within 14 days. We reserve the right to take the website offline after the final subscription period ends.
5. Setup Fee & Refunds
The one-time setup fee of £50.00 covers the initial design and build work. This fee is non-refundable once we have commenced work on your website, typically within 48 hours of receiving your completed onboarding form. If you cancel before we have begun work, the setup fee will be refunded in full within 14 days.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel from the date of purchase, unless you have expressly requested that we begin work before that period ends. By completing checkout you acknowledge and agree that we may begin work immediately, and you understand this may affect your right to a full refund of the setup fee.
6. Website Ownership & Access
While your subscription is active you have full access to and use of your website. The website is hosted on our infrastructure. If your subscription lapses or is cancelled, we reserve the right to take the website offline. All original design assets remain the intellectual property of Fifty unless otherwise agreed in writing.
7. Content & Acceptable Use
You are responsible for ensuring all content you provide (text, images, logos) is lawful and does not infringe any third-party rights. We reserve the right to refuse to publish content that is unlawful, defamatory, or otherwise inappropriate. We may update your website content on request but are not liable for any inaccuracies in content you supply.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you under this Agreement shall not exceed the total amount paid by you in the 12 months preceding any claim. We are not liable for any indirect, special, or consequential loss, including but not limited to loss of revenue, profits, or business opportunity.
9. Governing Law
This Agreement is governed by and construed in accordance with the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 30 days before any material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
